US 5321713 is a patent for the manufacture of laser elements using AlGaN crystals formed on a sapphire substrate. Seoul Semiconductor believes that Nissan Chemical's GaN-based laser diode products infringe the patent, and the export and sale of this product to the United States is unfair trade.

Seoul Semiconductor said that US 5321713, like the US patent "US 146465", is evidence that Seoul Semiconductors filed a patent infringement in July 2007 and sent the Nichia Chemical Industry to the US District Court for the Eastern District of Texas. This time, only the evidence of US 5321713 was submitted to ITC. On November 6, 2007, Seoul Semiconductor also used the US patent “US 5075742†as evidence to sue Nichia Chemical Industry to the US District Court for the Eastern District of Texas.
